MINISTRY OF HEALTHCARE OF UKRAINE: Order №1087 from 12.12.2013 "On some issues to ensure the production of corneal grafts"

"In accordance with the Law of Ukraine "On transplantation of organs and other anatomic human materials", the Regulation on the Ministry of HealthCare of Ukraine, approved by the Presidential Decree from 13 April 2011 № 467, the Resolution of the Cabinet of Ministers of Ukraine from 24 April 2000 № 695 "Some issues of implementation of the Law of Ukraine "On transplantation of organs and other anatomic human materials".

ORDER:

1. To establish the Dnepropetrovsk department of the State Enterprise "Bioimplant" the Ministry of HealthCare of Ukraine" located in the city of Dnepropetrovsk in the October street, 14."

Verkhovna Rada of Ukraine: Law # 1007-XIV from 16.07.1999 "On transplantation of organs and other anatomic human materials"

"This Law, taking into account the current state of science and the recommendations of the World HealthCare Organization defines the conditions and procedures for the use of transplantation as a special treatment method, ensures observance of human rights in Ukraine and the protection of human dignity in the application of transplantation and the implementation of other related activities.

Article 1. Conceptual definitions 

Anatomical materials – organs, tissues, anatomic structures, human or animal cells;

Bio-implants – medical means made of anatomical materials of deceased people. (Section 1, Article 1).

Article 3. Field of action of the law.

The operation of the Law applies to activities related to the sampling, storage and transportation of organs and other anatomic human materials of a man and their transplantation, manufacture of bio-implants, the receipt and use of xenografts.

Article 9. Activities related to the transplantation.

 - sampling the anatomical materials from deceased donors;

- storage and transportation of human anatomical materials;

- production of bioimplants.

Article 16. Conditions and procedure for sampling anatomical materials from the deceased for transplantation and (or) production of bioimplants.

Every adult capable person may give a written agreement or disagreement to become a donor of anatomical materials in the event of his or her death.

In the absence of such a declaration, anatomical materials from a deceased adult capable person may be taken by agreement with the spouses or relatives who lived with him or her until death.

In the case of the need for forensic examination, anatomical materials from the deceased donor are taken with the permission and in the presence of a forensic expert. Taking the anatomical materials should not interfere the course of the investigation, a forensic expert must notify about it the district (city) prosecutor within twenty four hours.

Article 20. Production and use of Bioimplants.

Producing Bioimplants, their use and quality control, the state registration and sale, importation into the customs territory of Ukraine and export outside its bounds with sticking to terms and order, established by the legislation of Ukraine on medical means."

Verkhovna Rada of Ukraine: The Law №1102-IV of 10.07.2003 "On the burial and funeral business"

"This Law determines the general legal framework for implementation in Ukraine of burial of the dead activities, governs the relations arising after death (fatality) of a person in respect of the burial procedures, and establishes guarantees of proper treatment to the body (remains, ashes) of the deceased and the preservation of the burial site.

Article 6. The right of citizens for burial of their bodies and the will of the proper treatment to the body after death.

All citizens have the right for burial of their bodies and the will of the proper treatment to the body after death. The will of the proper treatment to the body after death can be expressed as:

- Agreement or disagreement on the removal of organs and / or tissues of the body.

If there is no will of the deceased, the removal of organs and / or tissues of the body is carried out with the permission of the husband, wife, close relatives (parents, children, sister, brother, grandfather, grandmother, grandchildren), another person who has committed themselves to bury the dead and he or she has a corresponding death certificate. "
